Regarding the at fault driver's insurance company paying for your damage: they do have to speak with him or someone in his household who can confirm that the accident happened and what happened.
Think About it- do you want people to be able to call your insurance company – report claims against your policy – your policy pay them and your insurance company never spoke to you just to say hey did this accident happen? What happened? I'd be beyond mad if my insurance company paid under my policy and never spoke to me first. What if I did not think the accident was my fault?
So – yes the other company does have to try and confirm with their policy holder what happened.
Regarding the Tow Yard: the tow yard is charging storage for every day your car to sits in their yard. In my area, storage runs about 25 per day.
You have a legal duty to mitigate your damage – that means to not make them worse, The insurance company is putting on notice that you need to move the car from the tow yard because they are not going to pay for the car to sit in storage further.
If you have collision coverage – call your company and report the claim to them. They can pay the tow/storage charges and move the car.
If you do not have collision coverage – you will need to get with the tow yard and see about paying them for the tow and storage and moving the car. If the car is repairable – have it moved to the shop you want to do the repairs. Or you could see about moving the car to your home (where no storage charges will accrue).

Geeee…. Ithought the first thing Louisiana drivers did after an accident was call their attorney. I have YET to hear from a claimant in LA before I hear from their attorney!
So, maybe you ought to ask some of your friends….but, we are getting the same thing from our carriers. They HAVE to confirm that the accidnet actually happened and that the car wasn't stolen…..
I'd try to get your car out of the storage lot even if you have to have it towed.
